1. Definitions
“The Company”, “We”, “Us”, “Our” — refers to FlooringFirst, trading as Barnet Floor Sanders, including all associated trading names and service divisions.
“Client”, “You”, “Your” — means the person, company or organisation who accepts our quotation for the Services.
“Services” — means the wood-flooring, sanding, repairs, fitting, maintenance or other services provided by us.
“Site” — means the address at which the Services will be carried out.
“Quotation” — our written quotation or estimate for the Services.
“Force Majeure” — any event beyond our reasonable control (e.g., fire, flood, industrial action, equipment breakdown, inability to gain access, supply delay).
2. Contract Formation
By accepting our Quotation or placing an order with us you confirm your full acceptance of these Terms of Service and a binding contract is formed.
These Terms apply exclusively and supersede any other terms which you may seek to impose.
Any variation to these Terms must be agreed in writing by a director of the Company.
3. Quotations
Our Quotation is based on the details from our site visit or information provided by you. We aim to be thorough, but some hidden issues (subfloor condition, moisture, unforeseen damage) may only become apparent once work starts.
We reserve the right to adjust the Quotation if the actual scope varies significantly (typically more than 5 % difference in area or hidden repair requirement).
Quotation validity and acceptance terms will be set out in the quote.
4. Value Added Tax (VAT)
All quoted prices include VAT at the current rate unless stated otherwise.
You are responsible for paying all VAT and other applicable taxes.
5. Equipment & Access
We will provide all necessary equipment, tools and materials required to carry out the Services unless otherwise stated.
You must provide access to sufficient power and water at the Site, and ensure safe access for our team and equipment.
Delay or inability to access the Site may result in additional costs or rescheduling.
6. Payments, Surcharges & Late Payments
Unless otherwise agreed in writing, the remaining balance is due on completion of the Services.
We accept payment by bank transfer, card, or cheque (payable to Barnet Floor Sanders).
Interest may be charged on late payments at a rate of 2 % above the Bank of England base rate, and we reserve the right to take recovery action for unpaid amounts.
7. Cancellation & Rescheduling
You may cancel or reschedule with at least two working days’ notice without charge.
If cancellation or postponement is notified less than 48 hours before the agreed start, a cancellation or rescheduling fee may apply.
If operatives arrive and cannot proceed due to lack of access, furniture clearance or other Client-responsibility issues, a call-out fee may be charged.
8. Refunds
Refunds will only be considered under very limited conditions and must be submitted in writing following the complaints procedure.
Once Services have been completed and accepted, no refunds are available for services rendered.
9. Complaints
Any complaints must be submitted in writing within 7 calendar days of completion of the Services (or 3 days from discovery of an issue, but no more than 6 months after completion).
We will investigate and reply promptly, aiming to resolve issues either by repair, replacement or other remedy under our guarantee.
10. Claims & Losses
Our public liability insurance covers damage caused by our operatives while working on the Site.
You must notify us of any damage within 48 hours and allow us access to investigate and rectify where necessary.
We are not liable for items which you have not removed or protected, or which are damaged due to pre-existing condition, misuse or because you failed to follow after-care advice.
11. Liability
We are not liable for indirect or consequential losses (e.g., loss of income, anticipated savings, business interruption).
We are not responsible for delays or failure resulting from Force Majeure, lack of access, inadequate power or water, other trades interfering, or furniture not cleared.
We are not liable for typical wear expected on older floors, for surfaces that have already been heavily sanded or damaged beyond normal restoration, or for faults caused by inadequate maintenance.
12. Supplementary Terms
Any additional work, materials or variations requested by you and not included in the original Quotation will be charged separately.
Unless explicitly stated, quote excludes removal of old flooring, carpets, underlays or building-trade debris.
If you require us to work outside our standard area, or collect keys, after-hours, or store equipment overnight, extra charges may apply.
We reserve the right to update these Terms at any time; any changes will apply to future contracts, not those already executed.
13. Service Guarantee – Obligations & Limitations
We provide a [specify period] guarantee on our workmanship and materials subject to proper maintenance and usage.
The guarantee covers defects attributable to our workmanship or materials; it does not cover damage caused by misuse, neglect, moisture intrusion, movement of building, changes to heating or humidity, or other external factors.
Guarantee does not apply where you have entered into additional work with our operatives without written approval, or where after-care instructions have not been followed.
14. Insurance
We hold Employers’ Liability and Public Liability insurance and any other insurances required by law, covering our operatives and the Services at your premises.
We will provide proof of insurance on request.
15. Works Under CIS (for contractors)
If you are a contractor operating under the Construction Industry Scheme (CIS), you must provide appropriate documentation and purchase orders as required by HMRC.
Payments must comply with CIS regulations and applicable deadlines.
16. Governing Law
These Terms of Service shall be governed by the laws of England and Wales and any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
